OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about February 3, 2020, employees were exposed to struck-by hazards in the following instances while felling a tree: a) Non-involved workers were not beyond twice the height of the tree or trunk being removed. b) Wedges, block and tackle, rope, wire cable or other appropriate devices were not used to control the direction of fall when there was a danger that the tree being removed could fall in the wrong direction.
