29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a. A Sandblaster was exposed to a noise dose of 298.5%, or an equivalent dBA of 97.8 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 414 minutes during one shift on February 20, 2020.  The employer did not have a continuing, effective hearing conservation program.

On or about February 11, 2020, and at times previously, in the machine shop, the employer required an employee to use a N95 Particle Respirator for welding operations without first having the employee complete a medical evaluation, exposing the employee to health hazards such as, but limited to acute and chronic respiratory injury and illness.

On or about February 11, 2020, and at times previously, in the paint and sandblasting areas, the employer required employees to use tight fitting, half face, respirators and NOVA 2000 Air Supplied Hooded respirators, during the  abrasive blasting, painting, and welding operations, without training prior to an employee's use of a respirator, exposing these employees to health hazards such as, but limited to acute and chronic respiratory injury and illness.

29 CFR 1910.94(a)(5)(v): Operators shall be equipped with heavy canvas or leather gloves and aprons or equivalent protection to protect them from the impact of abrasives. Safety shoes shall be worn to protect against foot injury where heavy pieces of work are handled.  a. In the sandblasting room, located at 300 West Beresford Ave., Deland, Florida:  On or about February 11, 2020, the employer exposed an employee to struck-by hazards in that the company sandblaster did not wear safety shoes to protect against foot injury while handling heavy pieces of metal.
