OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to impalement hazards while walking by and working above the rebar that was in use as fence posts: On or about February 12, 2020 at the 80 South Main Street Construction Project, along the south and east side of the building: Employees were walking and working at, near, and above the rebar in use as fence posts that were not guarded to prevent impalement hazards while the employees were bolting up the steel working from an aerial lift. Employees were also exposed to the unguarded rebar while walking along the fence on uneven ground to access the north and west side of the building and while conducting safety walk arounds and inspecting the work progression. The rebar was about 36 to 38 inches from the ground and was 3/4 inches thick.
