29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Site - Employees were not provided with training on how to recognize a hazard while in an excavation where shear walls were up to 9 feet in depth and not protected from a cave-in hazard, on or about 02/11/2020.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not made after every rainstorm or other hazard increasing occurrence:  a) Site - A competent person failed to make an inspection of an excavation that was up to 9 feet in depth where rain had saturated the ground and an employee was standing near an unprotected shear wall, on or about 02/11/2020.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
