OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were permitted to operate a front-end loader with a missing windshield:     On or about February 13, 2020, in the company work/storage yard located at 13538 Okeechobee Boulevard in Loxahatchee, Florida, employees were exposed to a struck-by and/or unfiltered air hazards when operating a front-end loader that did not have the front windshield in place.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  On or about February 13, 2020, in the company work/storage yard located at 13538 Okeechobee Boulevard in Loxahatchee, Florida, employees were exposed to an ejection hazard when operating a front-end loader while not using the provided seatbelt.

29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signaled that it is safe to do so:  On or about February 13, 2020, in the company work/storage yard located at 13538 Okeechobee Boulevard in Loxahatchee, Florida, employees were exposed to struck-by/crushing hazards when working near and/or behind a front-end loader that did not have a functioning back up alarm.
