OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/falling object hazards while felling a tree:  a) Front yard - On or about February 13, 2020 and at times prior thereto, employee(s) were exposed to struck-by/falling object hazards while felling an unknown type of deciduous tree during arboricultural operations due to lack of planning, inspecting, and use of hard hats.   On February 13, 2020 an employee was struck by a fallen limb suffering a fatal fracture to the head.
