29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: a) Strongarm Designs - Welding Cubicles - On or about February 14, 2020, welding employees were utilizing compressed Argon/Nitrogen cylinders for performing TIG welding that were free-standing unsecured on the concrete floor, exposing employees to struck-by and compressed gas hazards. Abatement Note: Among other feasible means, cylinders must be stored in accordance with the Compressed Gas Association Pamphlet P-1 which states, "Section 3.2.3: Never drop cylinders nor permit them to strike against each other or against other surfaces violently" and "Section 3.4.4: Before using cylinder, be sure it is properly supported to prevent it from being knocked over".

29 CFR 1910.157(g)(1): An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting: a) Strongarm Designs - On or about February 14, 2020, employees using flammable liquids, such as Acetone, were provided fire extinguishers to use during incipient stage fire fighting, and the employer did not provide an educational program as required. ABATEMENT NOTE: By this date the employer must either correct the alleged violation or implement a Fire Safety Policy, as outlined in 29 CFR 1910.38(a) and (b) which included the evacuation requirement of 29 CFR 1910.157(b).

Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling: a) Strongarm Designs - On or about February 14, 2020, an employee was operating a hand held electric grinder and a fixed workstation light off of a relocatable power tap (power strip), exposing the employee to fire and electrical hazards. The relocatable power tap was not used in accordance with the listing or labeling. For Reference: Underwriters Laboratories (UL), refers to power strips as Relocatable Power Taps (RPTs) and, in its "General Information for Electrical Equipment Directory" (sometimes called the UL White Book or UL Directory) contains instructions that require UL-listed RPTs to be directly connected to a permanently installed branch circuit receptacle; they are not to be series-connected to other RPTs or connected to extension cords.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) Strongarm Designs - On or about February 14, 2020, employees were exposed to hazardous chemicals, such as but not limited to welding fume and acetone, and the employer did not develop and implement a written hazard communication program as required. ABATEMENT NOTE: A written program shall include descriptions of how the criteria for the following will be met: 1. Labeling, pictograms, and other forms of warning; 2. Safety Data Sheets; 3. Employee information and training. Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled. Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of safety data sheets, must also be addressed. The written program must be made available upon request.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: a) Strongarm Designs - On or about February 14, 2020, employees were utilizing acetone from secondary push-pump bottles that did not notify employees as to the chemical's identity and its associated safety and health hazards, exposing employees to chemical hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals and Safety Data Sheets.
