29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.   a) For employees working at the 3rd floor of building 2 in 1040 Chalet Suzanne Road in Lake Wales, as observed on or about 13 February, 2020. Employees were standing on makeshift 2"x4" lumber scaffolding while doing wood framing on the balcony. Employees were exposed to an approximate fall height of up to 25 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) For employees working at 1040 Chalet Suzanne Road in Lake Wales, as observed on or about 13 February, 2020. Employees were observed installing roof framing and sheathing on a 4.5:12 pitch roof without the use of a personal fall arrest system. Employees were exposed to an approximate fall height of up to 30 feet.

29 CFR 1926.502(b)(2)(i): Midrails, when used, were not installed at a height midway between the top edge of the guardrail system and the walking/working level; screens and mesh, when used, did not extend from the top rail to the walking/working level and along the entire opening between top rail supports; Intermediate members, when used gbetween posts, were more than 19 inches (.5 m) apart; Other structural members were installed such that there are no openings in the guardrail system that are more than 19 inches (48 cm) wide:   a) For employees working at 1040 Chalet Suzanne Road in Lake Wales, as observed on or about 13 February, 2020. The mid rail at the balcony was disconnected from one side and resting on the floor while 3 employees were framing the wall on the third floor balcony. Employees were exposed to an approximate fall height of up to 21 feet.

29 CFR 1926.503(b)(1): The employer did not verify fall protection training by preparing a written certification record:  a) For employees working at 1040 Chalet Suzanne Road in Lake Wales, as observed on or about 13 February, 2020. Three employees were observed not using any form of a personal fall arrest system and one employee was observed using a personal fall arrest system in which the components were damaged and not removed from service. The employer failed to provide a certified copy of fall protection training for the employees exposed to the hazards. Employees were exposed to an approximate fall height of up to 30 feet.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service:   a) For employees working at 1040 Chalet Suzanne Road in Lake Wales, as observed on or about 13 February, 2020. Employees were observed using a personal fall arrest system in which the lifeline deceleration webbing was previously deployed and refolded using framing nails to hold it together. Employees were exposed to an approximate fall height of up to 30 feet.
