29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. a. Located at 6600 Donn Eisele Street, Columbus, Ohio: On or about February 18, 2020, at the worksite location, the employer did not perform or certify a workplace hazard assessment. The employer had required employees to complete daily tasks without completing a written and certified evaluation of the workplace. Employees were exposed to crush injuries to their feet without the use of protective foot wear, working in and around forklifts and heavy pallet loads.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a. Located at 6600 Donn Eisele Street, Columbus, Ohio: On or about February 18, 2020, the employer had not developed a written hazard communication program at the worksite. Employees were tasked to operate and work around power industrial vehicles, such as but not limited to the LP petroleum gas, without having access to the information for the safe handling procedures for the of LP gas.
