29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)    On or about February 18, 2020, the employer did not maintain the Safety Data Sheet (SDS) for Kay QSR Heat-Activated Grill & Toaster Cleaner for employees using the product to clean grills at the 3418 Kohler Memorial Drive, Sheboygan, Wisconsin location.

29 CFR 1910.1200(h)(3): Training. Employee training shall include at least those items identified in section (h)(3)(i) through section (h)(3)(iv) of this section.     Employees of Kilian Management Services dba McDonalds did not receive training that included methods that may be used to detect the presence or release of a hazardous chemical in the workplace and the specific hazards that chemicals in the workplace present to employees.
