29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard").   a. On and/or before February 19, 2020, at the workplace, the employer did not provide respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard") where the employer determined that voluntary respirator use, such as the 3M 8511 N95 filtering facepiece (dust masks), were permissible.

29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request.   a. On or before February 19, 2020, an Amerex fire extinguisher (model: B456) that was in use as a backup on or about February 11, 2020, during a fire extinguishment test of a deep fryer in the gas test lab did not have an updated annual maintenance check since May 2014.
