29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress were not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: a) On or about 2/12/20, in an excavation in front of a building at 292 W. Utica Street, Buffalo, NY: An employee was working in a 9 ft. 10 in. wide x 11 ft. long x 8 ft. 7 in. deep excavation to replace a section of a 6 inch diameter sanitary sewer line. In order to exit the excavation, the employee climbed the banks in the northeast corner of the excavation. NO ABATEMENT CERTIFICATION REQUIRED

Utica Street, Buffalo, NY: An employee was working in a 9 ft. 10 in. wide x 11 ft. long x 8 ft. 7 in. deep excavation to replace a section of a 6 inch diameter sanitary sewer line. No protective system was being used to protect the employee from a cave-in hazard from the north, east, and west banks. NO ABATEMENT CERTIFICATION REQUIRED
