29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a)  Martin Venegas located at 10701 Killaloe Drive Dublin, OH 43017:  On and preceding February 19, 2020,  the employer did not ensure employees wore hard hats while performing work on the lower levels of the project below other workers and tools/materials. Framers were installing sheathing on a roof of a two story home and other framing pieces on the exterior at ground level beneath other workers. Employees periodically passed under the areas being worked with tools and materials directly above head and were not utilizing head protection which exposed them to struck by hazards to the head.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  Martin Venegas located at 10701 Killaloe Drive Dublin, OH 43017:  On and preceding February 19, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing sheathing and wood decking on the roof and second floor at heights that varied from 10-17 feet with open sides. The employees were not utilizing any form of fall protection which exposed them to falls up to 17 feet.  Martin Venegas was previously cited for a Willful violation of this occupational safety and health standard, which was contained in OSHA inspection number 1427508, citation number 2, item number 1 and was affirmed as a final order on February 24, 2020 with respect to a workplace located at 11920 Warbler Way, Plain City, OH 43064.  Martin Venegas was previously cited for a Willful violation of this occupational safety and health standard, which was contained in OSHA inspection number 1296904, citation number 2, item number 1 and was affirmed as a final order on May 1, 2018 with respect to a workplace located at 6224 Central College Road, New Albany, OH 43054.  Martin Venegas was previously cited for a Willful violation of this occupational safety and health standard, which was contained in OSHA inspection number 1223547, citation number 1, item number 1 and was affirmed as a final order on August 10, 2017 with respect to a workplace located at Building #15, Rolfe Road, New Albany, OH 43054.  Martin Venegas was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1177866, citation number 2, item number 1 and was affirmed as a final order on December 7, 2016 with respect to a workplace located at Life Style Communities Building, 14 Central Parkway, New Albany, OH 43054.   Martin Venegas was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1) which was contained in OSHA inspection number 1126073, citation number 2, item number 1 and was affirmed as a final order on April 12, 2016 with respect to a workplace located at 6505-6514 Yacca Way, Canal Winchester, OH 43110.

The employer did not initiate and maintain safety and health programs related to the framing work being conducted by employees. 29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a)  Martin Venegas located at 10701 Killaloe Drive Dublin, OH 43017:  On and preceding February 19, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Framers were installing sheathing and wood decking on the second floor of a home that varied from 10-17 feet with the employees working at different levels. The employees were not utilizing proper head or fall protection which exposed them to falls up to 17 feet and struck by hazards to the head.
