29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) 220 Franklin Road, Randolph, NJ 07869.    Employer did not administer a continuing, effective hearing conservation program for employees using orbital grinders on concrete furniture that were exposed to continuous noise at 93.64% of the permissible exposure level (PEL) eight hour time-weighted average sound level of 90 dBA.  The equivalent sound level of the measured dose is 89.5 dBA.  The action level is 85 dBA.  Sampling was performed for 462 minutes on 03/17/2020, with the unsampled portion of time considered to represent zero for the exposure calculation.    Violation occurred on or about 3/17/2020.

Employer did not ensure that the employees wearing 3M half-face respirators performing orbital grinding work were not exposed to silica-containing dust including, but not limited to, concrete furniture in excess of 50 ug/m3 over an 8-hour TWA.      One employee performing orbital grinding on concrete furniture was exposed to respirable crystalline quartz silica for eight hour time-weighted average respirable dust exposures of 280 ug/m3, which is 5.4 times the allowable exposure limit, the permissible exposure limit (PEL) 50 ug/m3.  Sampling was performed for 343 minutes on 3/17/2020, with the unsampled portion of time considered to represent zero for the exposure calculation.       Violation occurred on or about 3/17/2020.
