29 CFR 1910.146(c)(5)(ii)(D): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but there was a hazardous atmosphere within the space while an employee was inside the space:    On or about December 26, 2019, the employer did not ensure an employee welding inside a tank had a safe atmosphere within the space.  This condition exposed the employee to health hazards.

29 CFR 1910.146(c)(5)(ii)(H): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i), but the employer did not verify that the space was safe for entry and that the measures required by 29 CFR 1910.146(c)(5)(ii:    On or about December 26, 2019, the employer did not ensure employees had completed a written entry permit prior to engaging in welding operations within a tank.  This condition exposed employees to health hazards.

29 CFR 1910.146(k)(3): Whenever an authorized entrant entered a permit space to perform rescue services, retrieval systems or methods were not used to facilitated non-entry:    On or about December 26, 2019, the employer did not ensure appropriate rescue equipment was onsite and ready to use prior to engaging welding operations within a tank.  This condition exposed employees to health hazards.
