29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a) M.A. Mortenson Company at 1600 12th Ave. Denver, CO 80204: On or before 2/19/2020 the controlling employer did not ensure that all areas of the jobsite were inspected regularly to ensure employees and subcontractor employees were not exposed to serious hazards. Superintendents and safety personnel did not ensure that the area where the cisterns were located was free from fall and drowning hazards. Nine manholes were not guarded during and after concrete was poured around the manholes. A subcontractor employee fell through an unguarded manhole and into a cistern filled with water. The subcontractor died as a result. These conditions exposed employees and subcontractor employees to fall and drowning hazards.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) M.A. Mortenson Company at 1600 12th Ave. Denver, CO 80204: On or before 2/19/2020 the employer did not ensure that Mortenson employees and subcontractors were notified that if a subcontractor removed any cover from a jobsite confined space opening that such openings needed to be properly guarded by railing, barrier or cover. Unbeknownst to employer, a subcontractor removed nine cistern manhole covers. The openings were covered with plastic and later coated with snow. This condition exposed Mortenson employees to fall and drowning hazards.

29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: (a) M.A. Mortenson Company at 1600 12th Ave. Denver, CO 80204: On or before 2/19/2020 the controlling employer did not evaluate the jobsite for confined space hazards. Three cisterns with a total of nine manholes were not valuated as being confined spaces and were not inspected and guarded as such. These conditions exposed employees and subcontractor employees to fall and drowning hazards.
