29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about February 5, 2020, and at times prior, the employer did not ensure that employees utilizing respirators were medically evaluated prior to usage. The employer did not provide each employee who wore a 3M Half-Face tight-fitting respirators with a medical evaluation before respirator use or fit testing. This condition exposed employees to potential medical complications during respirator use. 29 CFR 1910.134(f)(2): The employer did not ensure that employees using tight-fitting face piece respirators were fit tested prior to initial use of the respirator, whenever a different respirator face piece was used, and at least annually thereafter: (a) On or about February 5, 2020, and at times prior, the employer did not ensure that each employee who wore a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator face piece was used, and at least annually thereafter. The employer required the use of respirators during automotive paint operations. This hazard exposed the employee to the lack of knowledge of proper respirator use and the use of a proper fitting respirator.
