OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls in excess of 4 feet. On or about February 19, 2020 and at times prior thereto and thereafter, the employer did not ensure that employees who access the top of hopper trucks are protected from fall hazards.

29 CFR 1910.30(a)(3)(i): The employer did not ensure that employees were trained in the nature of the fall hazards in the work area and how to recognize them. On or about February 19, 2020 and at times prior thereto and thereafter, the employer did not ensure that employees who access the top of hopper trucks are provided with training for fall hazards in the work area. Employees are exposed to falls of greater than four feet to the ground.
