29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  Located at 5182 Meadows View Lane, Lot 67, Hilliard, Ohio:  On or about February 20, 2020, the employer failed to ensure that an employee who worked in between the joist of the ceiling porch level of a new build residential home was protected from falling to the lower concrete ground level.  The employee was exposed to a fall distance of 11 feet 3 inches.   Ramon Cabrera was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1385371, Citation 2 - Item 1, and was affirmed as a final order on August 27, 2019, with respect to a workplace located at 5380 Booker Drive(Lot 47), Westerville, Ohio.   Ramon Cabrera was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1354471, Citation 2 - Item 1, and was affirmed as a final order on January 31, 2019, with respect to a workplace located at 8172 Rapala Lane, Pickerington, Ohio.   Ramon Cabrera was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1259143, Citation 1 - Item 1, and was affirmed as a final order on September 28, 2017, with respect to a workplace located at Lot 225, Etna, Ohio.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  Located at 5182 Meadows View Lane (Lot 67), Hilliard, Ohio:  On or about February 20, 2020, the employer did not maintain a safety and health program to ensure hazard detection, and correction while an employee installed framing lumber from in between the joist of the porch of the new build residential home.  The employee was unprotected from standing between the joist of the new build residential home.  The employee was exposed to a fall distance of 11 feet 3 inches to the concrete ground level.  Within the past five years, the employer had been cited for the same hazards in two different inspections.  Cabrera Construction was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1385371, with respect to citation number 3, item number 1/a and was affirmed as a final order on August 27, 2019, with respect to a workplace located at 5380 Booker Drive, Westerville, Ohio.  Cabrera Construction was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1354471, citation number 1, item number 1 and was affirmed as a final order on January 01, 2019, with respect to a workplace located at 8172 Rapala Lane, Pickerington, Ohio.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.  Located at 5182 Meadows View Lane (Lot 67), Hilliard, Ohio:  On or about February 20, 2020, the employer failed to instruct employees on the avoidance of hazardous conditions while they performed framing work at a new build residential home construction worksite.  Cabrera Construction was previously cited for a violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1385371, citation number 3, item number 1/b and was affirmed as final order on August 27, 2019, with respect to a workplace located at 5380 Booker Drive, Westerville, Ohio.
