Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  Located at 5182 Meadows View Lane, Lot 67, Hilliard, Ohio:  On or about February 20, 2020, the employer failed to ensure that an employee who worked in between the joist of the ceiling porch level of a new build residential home was protected from falling to the lower concrete ground level.  The employee was exposed to a fall distance of 11 feet 3 inches.   Ramon Cabrera was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1385371, Citation 2 - Item 1, and was affirmed as a final order on August 27, 2019, with respect to a workplace located at 5380 Booker Drive(Lot 47), Westerville, Ohio. Within the past five years, the employer had been cited for the same hazards in two different inspections.
