OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:    The employer is failing to protect employees from struck-by hazards.  This was most recently documented on or about January 2020 at Cobalt Boats, LLC, located at 1715 N 8th St Neodesha, Kansas.  The employer exposed employees to a struck-by hazard  while operating horizontal milling machine that are subject to ejecting parts in Building 14 the Wood Shop:    1) KOMO VR 512 MACH 1 SHO #55819-06    2) KOMO Xtreme 510 #01142-13    3) KOMO VR 510 MACH 18 #47917-07-01-04    5) KOMO 510 Serial number unknown    Among other methods, one feasible and acceptable means to correct this hazard includes but is not limited to the following;    1)  Comply with ANSI B11.19 4.2.1, which requires the user to ensure that risk reduction measures are provided, integrated, installed, maintained, and used in accordance with the requirements of this standard.     2)  Install safety devices in accordance with Clause 8 of ANSI B11.23 - 2002, (Safety Requirements for Machining Centers and Automatic, Numerically Controlled Milling, Drilling and Boring Machines)

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    Employees engaged in maintenance activities on the KOMO VR 512 MACH 1 SHO , serial number 55819-06 were exposed to hazardous energy, such as 480VAC and pneumatic power in that existing specific energy control procedures were not being used when locking out and tagging this equipment, increasing the potential for employees to miss a critical step, exposing maintenance employees to electrical hazards, amputation, caught-in, and struck by hazards.
