29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    On or about February 20, 2020, employees were installing new utility water lines and connecting them to existing utility lines by installing a "hot tap" inside of a trench that was approximately 6 feet deep. The competent person did not perform an inspection to classify the type of soil involved with the excavation project and did not implement protective measures for type C soil, which requires the most stringent protective measures, exposing employees to the hazards of soil collapse.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart.    Instance 1: On or about February 20, 2020 and at times prior thereto, employees were installing new utility water lines and connecting them to existing utility lines by installing a "hot tap" inside the west portion of a trench that was approximately 6 feet deep. Employees were working within a few feet of the near vertical walls, cut in the class B soil without adequate means to prevent cave-ins, exposing employees to the hazards of soil collapse.    Instance 2: On or about February 20, 2020 and at times prior thereto, employees were installing new utility water lines inside of the east portion of a trench that was approximately 5.7 feet deep. This section of the trench was only 3 feet in width, placing employees within a foot of the near vertical walls, cut in class B soil without adequate means to prevent cave-ins, exposing employees to the hazards of soil collapse.    The Patin Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(b)(2) , which was contained in OSHA inspection number 1443277, citation number 1, item number 6a and was affirmed as a final order on February 13, 2020, with respect to a workplace located at Roy Rivers Rd and Lee Dildy Blvd, Elgin, TX 78621.
