29 CFR 1910.101(b): "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6.    On or about February 25, 2020, the employer did not ensure that all compressed gases in cylinders were stored in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6.  A cylinder of oxygen by the southeast man door was not secured to prevent it from falling or being knocked over.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.    On or about March 11, the employer did not separate oxygen cylinders from acetylene cylinders by a minimum of 20 feet or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.  Two oxygen cylinders were stored next to three acetylene cylinders at the north end of the sawmill.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  On or about February 25, 2020, the employer did not verify that a workplace hazard assessment had been performed.  The employer had assessed the workplace and determined that steel toed shoes, hearing protection, eye protection, and gloves were necessary for the safety of employees, but could not provide a written certification of the assessment.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  On or about February 25, 2020, the employer did not provide the information contained in Appendix D to 29 CFR 1910.134 to employees using a respirator voluntarily.  Employees wear filtering facepiece respirators when exposed to dusty conditions during the production of hardwood lumber.
