29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to the work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    a) Water line, fire hydrant trench: On February 20, 2020 and at times prior thereto the employer had not instructed or provided their responsible person on site, with information on the requirements of working safely in a trench.  The responsible person did not recognize the hazards associated with the sub-contractor's work activities in a 6 to 7 foot deep trench to ensure the sub-contractor protected their employees to the extent possible.  These hazards included but may not be limited to lack of cave-in protective systems and safe egress.           b) Garbage dumpster pad excavation: On February 20, 2020 and at times prior thereto the employer had not instructed or provided their responsible person on site, with information on the requirements of working safely in an excavation.  The responsible person did not recognize the hazards associated with the sub-contractor's work activities in a 6 to 8 foot deep excavation to ensure the sub-contractor protected their employees, and employees of another sub-contractor, to the extent possible.  These hazards included but may not be limited to lack of cave-in protective systems, removal of imbedded debris, safe egress and placement of materials and equipment.      Note) Certification of corrective actions are required for these items.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a) Water line, fire hydrant trench: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure its sub-contractor protected their employees by having a safe means of egress out of a trench.  The sub-contractor employees worked in a 6 to 7 foot deep area of a trench without a ladder or other safe means of egress.      b) Garbage dumpster pad excavation: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure its sub-contractor's protected their employees by having a safe means of egress out of an excavation.  The sub-contractor who was performing the excavation and compacting work, provided a ladder for the sub-contractor who was performing soil testing activities within the excavation. The ladder provided was not used properly and did not extend above the top of the excavation wall.                   Note) Certification of corrective actions are required for these items.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations:     a) Garbage dumpster pad excavation: February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that the proper precautions were taken by their sub-contractor when working with another sub-contractor's employee in an excavation.  Hazards were created by one sub-contractor, to which their employee(s) and an employee of another sub-contractor, were exposed.  Hazards included, fill material piled on the top edge of the excavation, pre-existing landfill debris was not removed from the excavated walls, and heavy equipment was positioned on the edges of the excavation while digging and compacting.  The material, unstable debris and equipment posed a potential hazard of falling, collapsing or sliding into the excavation where the sub-contractor employee worked.               Note) Certification of corrective action is required for this item.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) Water line, fire hydrant trench: On February 20, 2020 and at times prior thereto, the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees to enter and work in a 6 to 7 foot deep trench.  The sub-contractor's employees were installing a water line, meter and fire hydrant without a cave-in protective system in place.    b) Water line, fire hydrant trench: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees to enter and work in a 6 to 7 foot deep trench. The sub-contractor's employees were not provided with a safe means of egress while installing a water line, meter and fire hydrant.         c) Water line, fire hydrant trench: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees to enter and work in a 6 to 7 foot deep trench. The sub-contractor's employees were exposed to struck-by hazards while installing water line, meter and fire hydrant where an existing concrete curb had been undercut and not supported.      d) Garbage dumpster pad excavation: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees, and an employee of another sub-contractor to enter and work in a 6 to 8 foot deep excavation. A cave-in protective system was not used while the sub-contractor's employees performed soil compaction activities where landfill debris had not been removed from the excavated walls.    e) Garbage dumpster pad excavation: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees, and an employee of another sub-contractor to enter and work in a 6 to 8 foot deep excavation.  The sub-contractor's employees performed soil compaction activities without a safe means of egress in place.          f) Garbage dumpster pad excavation: On February 20, 2020 and at times prior thereto the controlling employer, CM Company, did not ensure that their sub-contractor had conducted an inspection, by a competent person, prior to allowing their employees, and an employee of another sub-contractor to enter and work in a 6 to 8 foot deep excavation.  The sub-contractor's employees performed soil compaction activities where fill material and equipment had been placed on or very near the top edge of the excavated walls.          Note) Competent person for this sub part means one who is capable of identifying existing and predictable hazards in the surroundings, or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
