OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each employee employment and a place of employment which was free from the recognized hazard. On the west side of the construction site, framing employees were installing framing material while one employee elevated on the forks of a CAT TL642 forklift. The employee was exposed to approximately 9 foot fall hazard.
