29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: a) Third Level - An employee was using a pneumatic nail gun while attaching plywood on the vertical edge of floor joists and not wearing eye protection, on or about 02/20/2020. b) Lower Level - An employee was using a DeWalt portable electric circular saw to rip a wood two by and not wearing eye protection, on or about, 02/20/2020. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Third Level - An employee was attaching plywood on the vertical edge of floor joists and exposed to a 26 foot fall hazard, on or about 02/20/2020. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
