29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: Valley Builders Homes, Inc. at 9304 North Astoria Drive, Sioux Falls, SD 57106: On or about and at times prior to February 25, 2020 the controlling employer did not ensure that an accident prevention program was developed and implemented for the work environment to include regular inspections of the job site, materials, and equipment; conducted by a competent person. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)Valley Builders Homes, Inc. at 9304 North Astoria Drive, Sioux Falls, SD 57106: On or about and at times prior to February 25, 2020, the controlling employer did not ensure that subcontracted employees were protected from falls. Subcontracted employees were on site conducting roofing operations on a residential property with no fall protection system installed. This condition exposed subcontracted employees to fall hazards of over six feet.
