29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about February 17, 2020, at an excavation site located at 4th and Utica Tulsa, OK, inadequate protective devices were in place to protect an employee working in a trench that was more than 5 feet in depth, exposing the employee to the hazard of being crushed by falling soil.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the support system: On or about February 17, 2020, at an excavation site located at 4th and Utica Tulsa, OK, an employee was observed working in a trench greater than 5 feet deep with the bottom of protective system elevated more than two feet above the trench floor. The employee was exposed to struck by and crushing by hazards.
