29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  On or about February 19, 2020, the employer failed to ensure that employees who were voluntarily wearing various respirators, to include but not limited to, a N94 and various half masked respirators, were medically evaluated and cleared to wear such.

29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  On or about February 19, 2020, the employer failed to evaluate their facility to determine if there were any confined spaces that employees may be entering that would require a permit for entry.  Employees were entering the various tanks (for use as part of a tanker truck for misc. industries) as part of the fabrication of these tanks and are performing tasks to include but not limited to tacking and spot welding.

29 CFR 1910.178(a)(6): The employer did not ensure that all name-plates and markings were in place and maintained in a legible condition:  On or about February 19, 2020, the employer failed to ensure that the yellow CAT powered industrial vehicle and the orange Toyota (#156) had a name plate in place that identified important information about the vehicle including its load capacities.

On or about February 19, 2020, the employer failed to ensure that an employee tasked with the operation of a powered industrial vehicle was currently trained and certified to operate it.
