29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) Employees working in the Warehouse location at 754 E Knopf Road were not being trained in the safe operation of Reach Trucks and demonstrating competency prior to be allowed to operate those types of vehicles in the warehouse. b) Employees working in the Warehouse location at 754 E Knopf Road were not being trained in the safe operation of Stock Pickers and demonstrating competency prior to be allowed to operate those types of vehicles in the warehouse.

29 CFR 1910.184(c)(4): Slings shall not be loaded in excess of their rated capacities. On or about January 23, 2020, the hook element an alloy steel chain sling, that was used to hoist a 406 pound skid plate, failed because it was rated for only 350 pounds and resulted in the skid plate dropping onto an employees foot.

29 CFR 1910.184(e)(3)(i): In addition to the inspection required by paragraph (d) of this section, a thorough periodic inspection of alloy steel chain slings in use shall be made on a regular basis, to be determined on the basis of (A) frequency of sling use; (B) severity of service conditions; (C) nature of lifts being made; and (D) experience gained on the service life of slings used in similar circumstances. Such inspections shall in no event be at intervals greater than once every 12 months. On or about February 26, 2020, Generac Mobile Products had not conducted a periodic inspection of it's alloy chain slings, as described above, since March 7, 2018
