29 CFR 1910.23(b)(8): The employer did not ensure ladders were used only for the purposes for which they were designed: On or about 02/22/2020, AZZ dba Central Electric Manufacturing Company, located at 7911 Old US Hwy 54, Fulton, MO, were using ladder(s) at heights greater than the ladder was designed to be used. The 8 foot Louisville A frame (step ladder) with a Maximum Standing Height of 5 foot 6 inches (as labelled on the ladder) was used to reach a height much greater than the ladders rating. An employee fell from the ladder to the concrete floor and with the metal Buss Duct Flange/Throat coming down with him. The employee was hospitalized over the incident.

The employer must ensure: No employee carries any object or load that could cause the employee to lose balance and fall while climbing up or down the ladder: Previously and on or about 02/22/2020, AZZ dba Central Electric Manufacturing Company, located at 7911 Old US Hwy 54, Fulton, MO, employee(s) would climb ladders while carrying parts for the manufacturing of the electrical switchgear enclosures. One such part was the Buss Duct Flange which weighed approximately 60 lbs.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about 02/25/2020, AZZ dba Central Electric Manufacturing Company, located at 7911 Old US Hwy 54, Fulton, MO, had a Powered Industrial Truck (PIT) which had a torn seat (Toyota PIT , Model: 42-6FGCU30, S/N: 61810, Asset No.: 069). The seat was defective and in need of repair or replacement. There was a piece of metal also exposed due to the torn operators seat which could cause an injury to the operator.

29 CFR 1910.178(q)(6): Powered industrial trucks were altered so that the relative positions of the various parts were different from what they were when originally received from the manufacturer, by the addition of extra parts not provided by the manufacturer, or by the elimination of any parts without the manufacturer's approval: On or about 02/25/2020, AZZ dba Central Electric Manufacturing Company, located at 7911 Old US Hwy 54, Fulton, MO, the Toyota forklift, Model: 42-6FGCU30, S/N: 61810, Asset No.: 069, had the position of its horn relocated. This alteration required the addition of extra parts. The altered horn button was located on the right side of the steering column.
