29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    (a) On or about February 25, 2020, and at times prior, the employer, Carboy Winery, exposed employees to hazards during processing and cleaning activities in the "wine lab area" as well as in and around the fermentation tanks, aging tanks and CIP (Clean in place) tanks. The employer has not conducted an assessment to determine the required personal protective equipment needed to be used when potentially exposed to hazards included but not limited to, irritating and corrosive chemicals requiring specific gloves, eye protection and face shields. An employee conducting chemical mixing uses safety glasses instead of chemical goggles as well as uses nitrile gloves when cleaning tanks with caustic and reactive chemicals.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    (a) On or about February 25, 2020, the employer, Carboy Winery, did not ensure that employees, who are required to use sodium hydroxide, sulfur dioxide, caustic soda, peracetic acid, and potassium metabisulfite, which are corrosive chemicals, were provided access to an eye flushing station in case of chemical contact that are known to cause severe eye damage on the Safety Data Sheets (SDS).

During peak seasons pallets and materials are moved and placed in the warehouse area. This exposed employees to tipping and ejection hazards.

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:  On or about February 25, 2020, the employer, Carboy Winery, did not ensure that sufficient access to the electrical panels were provided and maintained. Carboard boxes and pallets were left in front and leaning on the electrical panels that service the production area adjacent to the wine "lab". This exposed employees to electrical hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a) On or about February 25, 2020, and at times prior, the employer, Carboy Winery, did not develop and implement a written hazard communication program which at least described how the criteria specified for labels and other forms of warning. Employee information and training was not provided, and methods used to inform employees of the hazards of non-routine tasks, had not been developed for employee exposures, such as but not limited to the following chemicals: Caustic Soda, Sulfur Dioxide, Carbon Dioxide, Sodium Hydroxide, Peracetic Acid, Potassium Metabisulfite, and Destainex.  This exposed employees to the physical and chemical hazards such as severe eye damage, and respiratory illnesses.  The Written program should include descriptions of the criteria for: 1.  Labeling and other forms of warning, 2.  Safety Data Sheets, and 3.  Employee information and training.    Additionally, a list of hazardous chemicals known to be present in the workplace must be complied. Methods used to inform employees of the hazards associated with non-routine tasks and information of workplace hazards must be addressed. The written program must be made available upon request.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):  On or about February 25,2020, the employer, Carboy Winery, did not ensure its employees were protected from chemical exposure in that each container of hazardous chemicals in the workplace were labeled, tagged or marked with the information required by the hazard communication standard. Employees in the production area were exposed to contact with chemical hazards in that three (3) large blue containers with Caustic Soda, Sodium Hydroxide (KMBS) and Tartaric Acid (H2T) and a blue spray bottle with 70% Ethanol were not labeled. All chemicals are known corrosive or caustic agents used for cleaning purposes.
