29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference 1926.59):  a) At the construction site, a written hazard communication program had not been maintained.  Subcontracted employees were exposed to hazardous substances such as silica when cutting stone veneer and using Portland Cement, Lime & Sand Mortar.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s) (Construction Reference 1926.59):  a) At the construction site, where a safety data sheet (SDS) for Portland Cement, Lime & Sand Mortar, a corrosive containing silica, was not maintained.  b) At the construction site, where a safety data sheet (SDS) for stone venner, a corrosive containing silica, was not maintained.

29 CFR 1910.1200(h)(2)(iii): The employer did not provide information to the employees as to the location and availability of the written hazard communication program, and material safety data sheets required by 29 CFR 1910.1200 (Construction Reference: 1926.59):  a) At the construction site, subcontracted employees using corrosives containing silica such as Portland Cement, Lime & Sand Mortar and veneer stone did not know the location and availability of the safety data sheet.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1:  a) At building 1 of an apartment complex, where the handheld power saw used to cut stone veneers was not equipped with integrated water delivery system that continuously feeds water to the blade, exposing subcontracted employees to inhalation hazards.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) At building 1 of an apartment complex, where the employer did not assess the subcontracted employees' exposure to respirable crystalline silica while the subcontracted employee was cutting stone veneers using handheld portable saw.
