OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to struck-by hazards from falling stock.  On or about February 25, 2020, the employer exposed employees to struck-by hazards by falling product/racks as sections of the racking system of all column base plates of the storage racks were not anchored to the floor with anchor bolts, approximately half of the racks in the facility were not anchored in the warehouse.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.   On or about February 25, 2020 the employer did not record the following workplace injuries on the OSHA Form 300 or equivalent for the calendar year 2019.  a. Back strain (lumbar) while lifting items at work and was prescribed medication.  Date of incident 12/31/19. b. Back strain (disc) while lifting items at work and prescribed prescription strength medication.  Date of incident 2/13/19.
