29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Work site was located at 321 NJ 440, Jersey City, NJ 07305  Employer did not provide training in recognition and avoidance of unsafe conditions relating to performing work inside an excavation. Employees were working in an open unprotected trench in Class C soil that was approximately seven feet, four inches deep and four feet, nine inches wide without cave-in protection.    Violation was observed on or about February 27, 2020.

Employees working inside were not wearing hardhats and were thereby exposed to over head hazards.  Violation was observed on or about February 27, 2020.

The water was seeping out of the sidewalls as well as coming from the old pipe that was being replaced.   Violation was observed on or about February 27, 2020.

The spoils piles were approximately three feet high and contained debris including large rocks. The spoil piles were set on the edge of the sidewall of the trench.   Violation was observed on or about February 27, 2020.

On 02/27/2020, one of the trench walls collapsed.   Violation was observed on or about February 27, 2020.
