29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.  a.  On or about February 27, 2020, at the above addressed jobsite, an inspection of the trench/ excavation was not performed by a competent person, thereby exposing employees to the hazards associated with cave-ins.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a.  On or about February 27, 2020, at the above addressed jobsite, employees were conducting cutting and removal of foundation shoring in a trench/ excavation measured at nine (9) feet seven (7) inches in depth.  The trench was not provided with cave in protection, thereby exposing the employees to cave in hazards.
