29 CFR 1926.501(b)(14): "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a. On or about February 28, 2020, located on the west side of the Luxe 88 Apartments stairwell, there was no top rail or any means of fall protection at the six foot wide window opening on the third floor exposing employees and subcontractors to a fall hazard of approximately 24 feet. b. On or about February 28, 2020, located on the west side of the Luxe 88 Apartments stairwell, there was no top rail or any means of fall protection at the six foot wide window opening on the fourth floors exposing employees and subcontractors to a fall hazard of approximately 34 feet. c. On or about February 28, 2020, located on the west side of the Luxe 88 Apartments to the right of the stairwell, there was no top rail or any other means of fall protection at the six foot wide window opening on the second floor exposing the employees and subcontractors to a fall hazard of approximately 12 feet. d. On or about February 28, 2020, located on the west side of the Luxe 88 Apartments to the right of the stairwell, there was no top rail or any other means of fall protection at the six foot wide window opening on the third floor exposing the employees and subcontractors to a fall hazard of approximately 24 feet. e. On or about February 28, 2020, located on the east side of the Luxe 88 Apartments at the left of center of the apartment building, there was a nine foot wide wall opening on the second floor that did not have standard guardrails or any other means of fall protection, thereby exposing the employees and subcontractors to a fall hazard of approximately 12. f. On or about February 28, 2020, located on the east side of the Luxe 88 Apartments at the left of center of the apartment building, there was a nine foot wide wall opening on the third floor that did not have standard guardrails or any other means of fall protection, thereby exposing the employees and subcontractors to a fall hazard of approximately 24 feet. g. On or about February 28, 2020, located on the east side of the Luxe 88 Apartments at the right of the center of the apartment building, there was a nine food wide wall opening on the second floor that did not have standard guardrails or any other means of fall protection, thereby exposing the employees and subcontractors to a fall hazard of approximately 12 feet.
