29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  On or about 02/25/2020 the employer designed and built a wooden scaffold system and was not a qualified person as evidenced by:     A. The employer was not aware of the requirement to support 4 times the intended load. The platform was constructed of 3-2x8s on the flat with 3-3/4" 4x8 sheets of plywood.  The 2x8s were  16'L.  The overhang on the uprights were approximately 1' on each side.      B. The employer was not aware of the guardrail requirements.  The scaffold had no guardrail system which exposed the employee to 10'7" fall. The employee was not wearing fall protection.   C. The employer constructed the vertical poles using 2x4s.  Most of the poles were not provided base plates or mudsills.  The soil was soft and wet after recent rains.  The employer did not secure the vertical uprights to prevent displacement.    D.  The employer was not familiar with the tables contained in subpart L appx A of the scaffold standard. The tables assist the employer in selecting the proper grade lumber and their capacities, loads and spans.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about 02/25/2020 employees were not provided safe access to their scaffold platform.  Their ladder did not extend at least three feet above the upper landing surface.
