29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards.  On or about 28 February 2020, three workers were performing framing activities on a residence under construction without the use of fall protection. These workers were not trained in recognizing fall hazards, exposing them to a fall hazard of approximately 20 feet to the ground.

29 CFR 1926.1053(b)(4): Ladder was not used for the purpose for which it was designed.  On or about 28 February 2020, framers used a fiberglass step ladder as means of access to the wood framing upper plate of a new residence under construction instead of using an extension ladder or other safe means. They used the top step and step below the top to climb to the elevated surface were framing work was performed. The ladder did not extent three feet past the landing surface, exposing the employees to the hazards of falls.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  On or about 28 February 2020, employees used a fiberglass step ladder as means of access to the wood framing upper plate of a new residential construction. 29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.    On or about 28 February 2020, and at times prior thereto, three worker were performing framing activities without the use of hard hats, exposing the workers to the hazard of being struck by falling tools, materials or debris.   Javier Costilla Lopez dba Lopez Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a) which was contained in OSHA inspection number 1407245, citation number 1, item number 1 and was affirmed as a final order on July 10, 2019 with respect to a workplace located at 513 Hidden Creek Way. Georgetown, TX 78626.
