29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    (a)Nohava Construction, Inc. at 208 Spruce Street, Vermillion, SD 57069: On or about and at times prior to March 4, 2020, the employer did not ensure employees were protected from fall hazards while installing flashing on an apartment building. The employer did not ensure that a safety monitor system was fully implemented to provide protection for employees installing flashing at the perimeter of the roof. This condition exposed employees to fall hazards of approximately 20 feet.

29 CFR 1926.502(h)(1)(iv): The safety monitor was not close enough to communicate orally with the employee:    (a)Nohava Construction, Inc. at 208 Spruce Street in Vermillion, SD 57069: On or about and at times prior to March 4, 2020, the employer did not ensure employees were protected from fall hazards when installing flashing in that, the identified safety monitors were not close enough to communicate orally with employees installing flashing on the exterior of the building. This condition exposed employees to fall hazard of approximately 20 feet.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function:    (a)Nohava Construction, Inc. at 208 Spruce Street, Vermillion, SD 57069: On or about and at times prior to March 4, 2020, the employer did not ensure employees were protected from fall hazards when installing flashing in that, identified safety monitors were observed installing a warning line system and assisting with installation of perimeter flashing, both activities could take the monitor's attention from the monitoring function. This condition exposed employees to fall hazards of approximately 20 feet.
