29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: (a)Edgar Miranda dba Miranda Construction at 6613 East 33rd Street in Sioux Falls, SD 57110: On or about and at times prior to March 6, 2020, the exposing employer did not ensure that employees performing roofing work on a low sloped roof at heights in excess of six feet above ground level were protected from fall hazards by use of an appropriate fall protection system. This condition exposed four employees to a fall hazard of approximately 10 feet.
