29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Located on the residential structures sheeted second floor employees involved in stud wall assembly associated activities were observed exposed to perimeter exterior fall hazards in excess of 11.3 feet and interior fall hazards in excess of 8 feet without conventional fall protection or other regulation compliant methods in use. Employees were also utilizing the single first to second floor access stairway and garage egress at which time employees were observed exposed to an unprotected approximate 39 inch by 48 inch floor hole which has a 9 foot fall hazard from the first floor to the basement.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employee(s) involved in residential stud wall assembly associated activities along various perimeter exterior and interior second floor areas were observed exposed to perimeter exterior fall hazards in excess of 11.3 feet, second floor interior fall hazards in excess of 8 feet and on the first floor employee(s) were observed egressing adjacent to an unprotected approximate 39 inch by 48 inch floor hole which has a 9 foot fall hazard from the first floor to the basement in which the exposed employee(s) were not knowledgeable of the procedures or regulations to be followed to minimize those hazards.

Located within the interior area of the residential structure from the first to the second floor employees were observed utilizing an unprotected 12 step high by 34 inch wide open sided stairway with fall hazards in excess of 6 foot 3 inches.
