29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    On or about March 9, 2020 the employer failed to establish a program for the control of hazardous energies during servicing and maintenance of equipment and machinery at the facility. Employees are tasked with servicing and maintaining equipment such as but not limited CNC machines, grinders, brazing equipment, and saw tooth tip machines. Hazardous energies present on the equipment includes but is not limited to electrical, mechanical, thermal, and pneumatic.     Employees were observed servicing and maintaining equipment at the time of the inspection such as the tempo freestyle grinder. Additionally, employees had access to and utilized keyways for the opening of control panels and equipment panels on equipment. The panels were accessed with the keyway without the control of hazardous energies being performed prior to opening them.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place on the cnc machine (CHD250). The interlock device on the door did not function to protect the employee from the moving machine parts of the equipment. The door could be opened during production activities. The rear door had also been modified to allow for larger saw blades to fit inside the machine thus not being able to prevent employee entry.     b) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place on the cnc machine (CHD251r2). The interlock device on the door did not function to protect the employee from the moving machine parts of the equipment. The door could be opened during production activities. The rear door had also been modified to allow for larger saw blades to fit inside the machine thus not being able to prevent employee entry.     c) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place on the cnc machine (chf270r1). The interlock device on the door did not function to protect the employee from the moving machine parts of the equipment. The door could be opened during production activities. The rear door had also been modified to allow for larger saw blades to fit inside the machine thus not being able to prevent employee entry.     d) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place to protect employees from the moving machine parts of the automatic brazing machines (3). No machine guarding was equipped on the machines to protect the operators.     e) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place to protect employees from the moving machine parts of the Enokida fully automatic saw tooth tip machines (3). No machine guarding was equipped on the machines to protect the operators.    f) On or about March 9, 2020 the employer failed to ensure that effective machine guarding was in place to protect employees from the moving machine parts of the cnc grinders. No machine guarding was equipped on the machines to protect the operators.
