The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of guardrail systems, safety net systems or personal fall protection systems: 69 Federal St., Belchertown, MA: On or about March 4, ,2020, 2 employees were observed leaning out a 2nd story window with an inside bottom edge 24 inches above the walking surface and more than 11 feet above the deck below without use of any fall protection/restraint. The employees were receiving the delivery of sheet goods for the remodeling of this residence Marjam Supply Company, Inc was previously cited for a violation of an equivalent standard, 1910.132 (a) 1, which was contained in OSHA inspection number 11262249, citation number 1, item number1 and was affirmed as a final order on 3/29/2016, with respect to a workplace located at 243 Steele Rd., West Hartford, CT.
