29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 3208 REX DRIVE, YORK, PA - Employees performed roofing operations, the employees were not protected by any means of fall protection, on or about March 5, 2020. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: (a) 3208 REX DRIVE, YORK, PA - Employees accessed the South end of the Front of the house using a Werner 20 foot extension ladder, and the rungs of the ladder were only approximately eight inches past the upper landing surface, on or about March 5, 2020. (b) 3208 REX DRIVE, YORK, PA - Employees accessed the North end of the rear of the house using an unmarked 40 foot extension ladder, and the rungs of the ladder were only approximately 18 inches past the upper landing surface, on or about March 5, 2020. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed: (a) 3208 REX DRIVE, YORK PA, REAR OF HOUSE SECOND STORY - Employees accessed the second story roof from the first story roof by using a Werner six foot step-ladder that was in the closed position and leaned against the side of the house, on or about March 5, 2020. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
