29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about March 3, 2020, the employer did not ensure that employees, standing on the top plates of a building installing trusses, were protected from falling and in use of fall protection. This exposed the employees to a fall hazard greater than six (6) feet to the ground below.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about March 3, 2020, at the jobsite the employer did not have written approval, from the powered industrial truck manufacturer, to allow an employer made spreader bar with attachment to be mounted to the fork of the powered industrial truck. The operator used this modification to lift trusses and this exposed the employees to struck-by and crushed-by hazards.
