29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: On or about March 9, 2020, a competent person was on site but did not conduct an inspection of a trench to ensure conditions did not exist that could result in possible cave-ins, exposing employees to the hazard of being crushed by falling soil. Carstensen Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1035187, Citation 1, Item 2a, and was affirmed as a final order on August 3rd, 2015, with respect to a workplace located at 10372 Second Street SW, Killdeer, North Dakota. Carstensen Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1169464, citation number 2, item number 1a, and was affirmed as a final order on December 13, 2016, with a final abatement date of November 22, 2016, with respect to a workplace hazard located three miles west of Stanley on highway 2 in Stanley, ND 58784.
