A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On March 11, 2020, located in an excavation on a residential construction site, an employee working inside aluminum hydraulic shoring without a safe means of egress in which an extension ladder located outside the shoring exposing the employee to a cave-in hazard.

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request. On March 11, 2020, located in an excavation on a residential construction site, a copy of the manufacturer's specification, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, for the Efficiency Production Aluminum Hydraulic Shoring, was not maintained on-site during construction of the protective system and could not be provided to the Secretary at the time of the inspection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On March 11, 2020, located in an excavation on a residential construction site, an employee utilized an extension ladder located inside a 9' in-depth excavation that did not extend past the upper landing surface 3', allowing an employee a handrail a safe means of accessing or egressing from the excavation.
