29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a)  On or about April 29, 2020; verification and abatement:  The employer failed to provide verification of abatement for citation 1, item number 1 from inspection 1469752 which was issued on April 7, 2020 and had a final contest date of April 28, 2020.  b)  On or about April 29, 2020; verification and abatement:  The employer failed to provide verification of abatement for citation 2, item number 1 from inspection 1469752 which was issued on April 7, 2020  and had a final contest date of April 28, 2020.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 10125 Dunleith Loop, Lot 134 Old Field, Daphne, Alabama:  On or about March 16, 2020 and at times prior; the employer allowed his employees to perform roofing activities without fall protection exposing his employees to a fall hazard of 10 feet 5 inches to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 10125 Dunleith Loop, Lot 134 Old Field, Daphne, Alabama:  On or about March 16, 2020 and at times prior; the employer allowed his employees to use an extension ladder to gain access to the roof and the rails of the ladder did not extend three feet above the roof landing to provide safe access exposing his employees to a fall hazard of 9 feet 4 inches to the ground below.    THE JUAN SALAS DBA JUAN SALAS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053 (B)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1392341, CITATION NUMBER 1, ITEM NUMBER 2, GROUP A AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 7, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 1316 & 1320 TIGER LILY LANE, COTTAGES ON THE GREENE, FOLEY, ALABAMA.
