The employer did not initiate and maintain safety and health programs related to the roofing work being conducted by employees.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Mario Ballia located at 726 Nighthawk drive, Plain City, OH 43064: On and preceding March 19, 2020,  the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were installing shingles and other roofing materials on the second floor at heights up to 22 feet with the employees working at different levels. The employees were not utilizing proper head or fall protection which exposed them to falls up to 22 feet and struck by hazards to the head.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Mario Ballia located at 726 Nighthawk drive, Plain City, OH 43064: On and preceding March 19, 2020, the employer did not ensure employees wore hard hats while performing work on the lower levels of the project below other workers and tools/materials. Roofers were installing shingles and other materials on a roof of a two story home working at different levels of the roof. Employees periodically passed under the areas being worked with tools and materials directly above head and were not utilizing head protection which exposed them to struck-by hazards to the head.

Roofers were installing shingles and other roofing materials on the second floor at heights up to 22 feet without fall protection. The following condition exposed them to falls up to 22 feet and struck by hazards to the head.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Mario Ballia located at 726 Nighthawk drive, Plain City, OH 43064: On and preceding March 19, 2020,  the employer did not ensure that the a portable extension ladder used to gain access to the roof extended at least three feet beyond the eave that they were using for access.  Roofers were utilizing an extension ladder to access the second floor roof of a two story residential home which was positioned approximately 12 inches above the upper landing they were accessing.  The following condition exposed employees to falls up to 22 feet.
