29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) New residential construction located on Lot #42, West side of structure: On or about 03/18/2020, and at times prior, the employer exposed employees to silica dust exposure while cutting CEMPLANK Siding, in that the Makita 7-1/4-inch Circular Saw was used to cut a fiber cement product and was not equipped with a dust collection system as required by Table-1 when working with materials containing crystalline silica.
